Failure of the player to attend all lessons in the allocated session does not relieve me of my obligation to pay the fees in full. This agreement is NON-CANCELLABLE, NON-TRANSFERABLE, NON-REFUNDABLE. I understand and agree that all exercises, session activities and practices are undertaken at player's and member's own risk. I understand that there is a risk of personal injury and with this knowledge agree to indemnify and save harmless Holmes Elite Health and Fitness from all loses caused by any accident or injury to the player, or to third persons, who may be with the player, in the event that either the player or said third person is injured in any way. I understand that strict observation by me of the rules and regulations relative to my training will largely eliminate the possibility of accident or injury and that I indemnify, act, hold harmless and waive any claim of damages against Holmes Elite Health and Fitness, its principles, instructors, or players for any injury or legal obligation resulting from participating in sessions or during practice. I understand and agree that neither Coach Seon Holmes, my instructors, my fellow players, nor any facility through which I receive my training, nor any parent or subsidiary of the foregoing, nor any of their respective employees, officers agents or assigns (hereinafter referred to as "Released Parties") may be held liable or responsible in any way for any injury, death, or other damages to me or my family, heirs or assigns that may occur as a result of my participation in this training program or as a result of the negligence of any party, including the Released Parties, whether passive or active. In consideration of being allowed to enrol in this training program, I hereby save and hold harmless said program, and I personally assume all risks in connection with said program, for any harm, injury or damages that may befall me while I am enrolled as a participant in this training program, including all risks connected therewith, whether foreseen or unforeseen. I also understand that fitness training is a physically strenuous activity and that I will be exerting myself during this training program, and that if I am injured as a result of heart attack, aneurysm, panic, hyperventilation, trauma, tendon and ligament injury, broken bones, head injury, blinding, orthodontic injury, joint dislocation, bruising, cuts and abrasions, sprains, cardiovascular, nerve or spinal injury, brain damage and/or death that I expressly assume the risk of said injuries and that I will not hold the above listed individuals, companies or entities responsible for the same. The player agrees to allow any photographs/videos taken in connection with Holmes Elite Health and Fitness activities to be used for promotional and advertising purposes Holmes Elite Health and Fitness, and the agent and employees shall not be responsible for damaged, lost or stolen articles, inside or outside of the facility. The player may not assign, sell or otherwise transfer any rights under the Agreement. I agree to take lessons at Holmes Elite Health and Fitness for the tuition and arrangements as indicated on both sides of this form. RULES AND REGULATIONS FOR Holmes Elite Health and Fitness 1. All players will show self control, good sportsmanship and respect for the instructor and fellow players at all times. 2. All players must obey all directions by the coaching staff at all times. 3. There must be no eating, gum chewing, swearing, or any other conduct that in the coach’s opinion is detrimental to the atmosphere of the class.
